Jessyfish Terms & Conditions 

 

Welcome to our Terms and Conditions! When you accept a Jessyfish offer and confirm a booking with us (either digitally, in writing, or verbally), you agree to the following terms.

1.  Definitions


1.1   In our Terms and Conditions, the subsequent words are defined as follows: 
1.2   “Performance:” the act or engagement for which Client has booked Jessyfish; 
1.3   “Client:” the natural or legal entity who has booked a Performance; 
1.4   “Artists:” An individual or group of natural persons responsible for the performance of one or more act(s) offered by Jessyfish;
1.5   “Fee:” The agreed-upon price of the Performance to be paid by Client to Jessyfish.
 

2.  Client Obligations


2.1   Client will ensure and warrants towards Artists that (i) the safety of the Artists is guaranteed before, during, and after the Performance, including the provision of food and water for Artists, (ii) the audience present at the Performance will behave in way that is not unsafe or offensive to the Artists, (iii) when Artists arrive at the venue for the Performance, Client will provide a contact person who is aware of matters relating to the Performance. 
2.2   As Artist safety is paramount, if Client cannot ensure Artist safety, Jessyfish reserves the right to instruct Artists to leave the Performance venue and full compensation will be due. 
2.3   Please refer to our Artist Rider for additional needs relating to our Performances.
 

3.  Cancellation Policy

 

3.1   In the event that Client cancels or postpones the Performance for any reason, either a partial or full payment of the agreed-upon Fee will be due, schedule as follows:

3.1.1   If Client cancels or postpones the Performance more than two months (sixty days) before the scheduled performance date, no Fee shall be due; 

3.1.2   If Client cancels the Performance within sixty days of the scheduled performance date, 50% of the Fee will be due to Jessyfish;

3.1.3   If Client cancels the Performance within two weeks (fourteen days) of the scheduled performance date, 75% of the fee will be due to Jessyfish;

3.1.4   If Client cancels the Performance within 48 hours of the scheduled performance date, 100% of the fee will be due to Jessyfish;

3.1.5   If Client postpones or changes the scheduled date of the Performance within one month (thirty days) of the originally scheduled Performance date, 25% of the Fee will be due to Jessyfish;

3.1.6   If Client postpones or changes the scheduled date of the Performance within one week (seven days) of the originally scheduled Performance date, 50% of the Fee will be due to Jessyfish;

3.2   In the event of a cancellation or postponement due to force majeure, no Fee shall be due. 

3.2.1   Failure by Client to obtain the required permits or permissions does not constitute force majeure.
 

4.  Liability and Insurance
 

4.1   Client agrees that neither Artists nor Jessyfish shall be held liable for any loss, damage, death, or personal injury arising from or in connection with the Performance, excluding intent or gross negligence on the part of the Artist or Jessyfish. 

4.2   Artist and Jessyfish are not liable for damage of whatever nature caused by Artist reliance on incorrect or incomplete information provided by Client. 

4.3   Client indemnifies Jessyfish and all staff members (including Artists) against all claims from third parties which in any way relate or arise from the Performance, excluding intent or gross negligence on the part of the Artist or Jessyfish. 

4.4   In the event that any movable goods (such as Artist performance props or Artist costumes) are damaged by Client or any guests of Client (including guests at the Performance), Client shall be liable for the cost to replace or repair the goods. 

4.5   Client acknowledges that there is currently no insurance available for Artists or performers.
 

5.  Payment Terms
 

5.1   Client agrees to pay the Performance Fee to Jessyfish within thirty (30) days of receipt of the invoice. 

5.2   In the event that Fee payment has not been received by Jessyfish within 30 days of sending the invoice, Client will pay a late payment fee of 2.5% of the Fee. 

5.3   In the event that Fee payment has not been received by Jessyfish within 45 days of sending the invoice, Client will pay a late payment fee of 5% of the Fee.
 

6.  Content & Sharing
 

6.1   Client agrees that any content (photos, videos, etc.) created during the Performance can be used without limitation for Artist’s promotion on any platform that Artist uses for promotion. 

6.2   In the event that Client shares content on any digital platform or physical promotional material (including all social media accounts and printed material) which prominently features Jessyfish and/or Jessyfish Artists, Client agrees to duly credit Jessyfish.

6.2.1   If Client shares content on Instagram that features Jessyfish and/or Artists, Client will tag @jellyjessyfish. 

6.2.1   If Client shares content on Facebook, Client will tag the Jessyfish Facebook page (@jessyfishIPM). 

6.2.1   If Client prominently features Jessyfish or Jessyfish Artists for physical printed promotional material, Client will visibly include on the physical material the phrase “Performance Art by Jessyfish.” 

6.3   If Client does not credit or tag Jessyfish per the above conditions, Client agrees to repost or reprint the material with credit to Jessyfish.
